2. Legal Bases

We collect and process your personal data exclusively on a legal basis, in particular on the basis of the General Data Protection Regulation of the European Union (GDPR).

If we obtain your consent for processing operations for specific processing purposes, the legal basis for processing is Art. 6 para. 1 lit. a) GDPR.

If we require your personal data to process contractual or pre-contractual relationships with you as the data subject (e.g. delivery of goods, provision of services), the processing is carried out on the basis of Art. 6 para. 1 lit. b) GDPR. This also applies to directly related processes such as the processing of enquiries about our products, services or prices.

If we process your personal data based on statutory obligations, this is done on the basis of Art. 6 para. 1 lit. c) GDPR.

In the event that we need your personal data in order to protect your vital interests or those of another natural person, the processing is carried out on the basis of Art. 6 para. 1 lit. d) GDPR.

Regardless of the afore-mentioned legal bases, we process your personal data on the basis of Art. 6 para. 1 lit. f) GDPR if the processing is necessary to safeguard a legitimate interest on our part or that of a third party, provided that your interests, fundamental rights and freedoms do not prevail.

The storage of information in the end user's terminal equipment or access to information already stored in the terminal equipment is only permitted if it is covered by one of the following justifications:

  • Section 25(1) TDDDG: If the end user has given their consent on the basis of clear and comprehensive information. Consent must be given in accordance with Art. 6(1)(a) GDPR;
  • Section 25(2)(1) TDDDG: If the sole purpose is to carry out the transmission of a message via a public telecommunications network; or
  • Section 25 (2) No. 2 TDDDG: If storage or access is absolutely necessary for the provider of a digital service to be able to provide a digital service expressly requested by the user.

3. Collection of personal data when you visit our website

When you use our website, data transmitted to us by your browser is processed and stored on our server. This data is necessary for the provision of the content and services of our website and serves to display the website properly and to ensure security and stability. This data usually includes the following:

6. E-Mail / Contact Form

If you contact us by email or via the contact form, we will process the data you provide (e.g. title, surname and first name, address, company, email address and the time of transmission) in order to process your message. Once storage is no longer necessary, we delete the transmitted data or restrict its processing. This depends on statutory retention obligations.

7. Call Button

If you contact us via Call-Button and telephone call, the data you provide, in particular your telephone number, will be processed by us in order to process your contact request. Alternatively, you must call with hidden number.

8. Newsletter

If you register for our newsletter, the data you provide will be used exclusively for this purpose. For an effective registration you need a valid e-mail address. In order to ensure that the registration is actually carried out by you, we will at first send an e-mail to the indicated e-mail address after registration, asking you to confirm the registration. By confirming the registration you inform us that you agree to the registration (so-called double opt-in procedure). We log your registration for the newsletter, the sending of the confirmation e-mail and the receipt of your confirmation.

We would like to point out that we evaluate your user behaviour when sending the newsletter. For this evaluation, the e-mails sent contain so-called web beacons or tracking pixels, which are single-pixel image files that are stored on our website. For the evaluations, we link the aforementioned data and the web beacons with your e-mail address and an individual ID. Links contained in the newsletter also contain this ID. The data is only collected pseudonymously, i.e. the IDs are not linked to your other personal data, a direct personal reference is excluded.

You can at any time terminate your subscription to the newsletter and revoke your consent to the storage of data stored for sending the newsletter. For this purpose, there is a corresponding link in every newsletter. You can also unsubscribe directly via our website or by contacting us via the aforementioned contact methods.

9. Registration and Login

You have the possibility to register on our website and log in. In doing so, you will be requested to provide us with the personal data that can be seen from the input masks, which will then be transmitted to us. This data is collected and stored by us exclusively for internal use and for our own purposes. We may arrange for this data to be passed on to third parties, e.g. to a service provider or an order processor to process the contractual relationship, who also uses the personal data exclusively for internal use attributable to us.

By registering and logging in to our website, your IP address, the date as well as the time of registration can also be saved. This is done for the purpose of preventing misuse of our services and, if necessary, creating the opportunity to investigate criminal offences.

If you voluntarily make personal data available to us, the processing serves to offer you content or services which, for factual reasons, can only be offered to registered users. You have the possibility at any time to change the personal data provided during registration or to have them completely deleted.

We will inform you at any time about which of your personal data we have stored. We will correct or delete your data on request, unless we are legally obliged to store them.

10. Use of our spare parts shop

If you want to order in our spare parts shop (shop.gloriagarten.de), it is necessary for the conclusion of the contract that you enter your personal data, which we need for the completion of your order. Required information for the execution of the contracts are marked separately, further information is voluntary. We process the data provided by you to process your order. For this purpose we can pass on your payment data to our house bank. The legal basis for this is Art. 6 para. 1 sentence 1 lit. b DS-GMO.

You can voluntarily create a customer account through which we can store your data for future purchases. When you create an account under "Register", the data you have provided will be saved revocably. All other data, including your user account, can always be deleted in the customer area.

We may also process the information you provide to inform you of other interesting products in our portfolio or to send you e-mails containing technical information.

We are obliged by commercial and tax law to store your address, payment and order data for a period of ten years. However, after[two years] we will limit processing, i.e. your data will only be used to comply with legal obligations.

To prevent unauthorized access to your personal data, especially financial data, the order process is encrypted using TLS technology.

11. Online Order Processing / Shop

If you voluntarily provide us with personal data when placing an order or registering a customer account, we will store and process the data. If stated so in the input form, these are mandatory fields because we need the data to process your contact request, to open your customer account or to process the contract. The scope of the data collected can be seen from the input forms.

We use the data to process your inquiries and to process the contract. As soon as the processing of the contract is completed or your customer account is deleted, your data will be restricted for further processing and deleted after expiry of the statutory retention periods if you have not expressly consented to further use of your data or if we reserve the right to use the data within the framework of statutory regulations. You can have your customer account deleted at any time by sending us a message.

We pass on your data to a company commissioned with the processing or delivery of our goods, insofar as this is necessary for processing. In this case you will receive legal information via the respective partner.

12. Payment Processing

Within the framework of order processing, various payment services are offered. Please note that information regarding the order, the addressee and the costs will be passed on to the selected payment company for payment processing.

13. Warranty Extension

You have the option of registering for a warranty extension on our website. This is possible under the conditions described at https://www.gloriagarten.de/gloriafriends/. In doing so, you will be asked to provide the personal data shown in the input masks and this data will be transmitted to us. This data is collected and stored by us exclusively for internal use and for our own purposes. We may arrange for this data to be passed on to third parties, e.g. for the purpose of processing the contractual relationship to a service provider or an order processor, who will also use the personal data exclusively for an internal use attributable to us.

When registering, your IP address, the date and the time of registration may also be stored. This is done for the purpose of preventing misuse of our services and, if necessary, to make it possible to investigate criminal offences.

If you voluntarily provide us with personal data, the processing serves the purpose of offering you content or services that can only be offered to authorized users for the reasons outlined above. You have the option at any time to change the personal data provided during registration or to have it deleted completely.

We will provide you at any time with information about which of your personal data we have stored. Upon request, we will correct or delete your data unless we are legally obliged to retain it.

14. Google Analytics

For our website we use Google Analytics, a tracking tool of Google, LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA ("Google"). Google Analytics uses so-called "cookies" (see above under "cookies"), which are stored on your computer and allow an analysis of your use of the website. The thus generated information about your use of our website is usually transferred to a Google server in the USA and stored there. However, due to the activation of IP anonymization on this website, your IP address will be shortened by Google beforehand within Member States of the European Union or in other contracting states to the Agreement on the European Economic Area.

Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on website activity and to provide further services associated with the website use and Internet use to the operator of the website. The IP address transmitted by your Internet browser in the context of Google Analytics will not be merged with other Google data.

The data sent and linked with cookies, user recognition (e.g. user ID) or advertising IDs will automatically be deleted after 14 months.  Data whose retention period has been reached is automatically deleted once a month. On our website we use Google Maps API, an online map service of Google, LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA ("Google") to visually display geographical information.

16. Google Fonts

On our website we use the Google Fonts font library to display the contents correctly and in a graphically appealing manner, regardless of the Internet browser used. Google Fonts is a service of Google, LLC, Amphitheatre Parkway, Mountain View, CA 94043, USA ("Google"). When the font library is accessed by opening our website, this is done locally. Otherwise and only upon consent, a connection to Google servers is automatically established, usually to servers in the USA. In this case, it is possible that this may involve data being transmitted to Google, such as which Internet pages you have accessed, the access time, your IP address and which Internet browser you use. 17. Google AdWords

Our website uses Google AdWords with Google Conversion Tracking, a service provided by Google, LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (‘Google’), see https://policies.google.com/privacy. If you have reached our website via an advertisement placed by Google, Google AdWords will place a cookie on your computer.

This enables us and Google to recognise that the user has clicked on the ad and was directed to that page. Cookies cannot be tracked through AdWords customer websites. After 30 days, these cookies lose their validity and are not used for personal identification. Conversion statistics tell customers the total number of users who clicked on their ad and were directed to a page tagged with a conversion tracking tag. The setting of a cookie can be rejected through browser settings. This can lead to functional limitations of the website.

19. Facebook Remarketing

Our website uses remarketing functions from Facebook: Meta Platforms Ireland Limited, Merrion Road, Dublin 4, D04 X2K5, Ireland.

This function is used to analyse our online offering in order to optimise its economic operation. It enables us to define visitors as a target group for our offering for the display of advertisements and to control interest-based advertisements. This transmits to the Facebook server which of our pages you have visited. If you visit Facebook as a logged-in user, you will subsequently be presented with personalised, interest-based advertisements.

20. Adform

Adform is a service used to analyse user behaviour, in particular to anonymously link offers and advertising to specific customer interests. The provider is Adform A/S, Rosenborggade 15, 2nd floor, 1113 Copenhagen, Denmark, see https://site.adform.com/privacy-center/overview/ .

21. Trusted Shops

In order to display the Trusted Shops seal of approval and any reviews collected, as well as to offer Trusted Shops products to buyers after they have placed an order, the Trusted Shops Trustbadge is integrated into this website to optimally promote our offers. This is a service provided by Trusted Shops SE, Subbelrather Str. 15C, 50823 Cologne, Germany.

When the Trustbadge is called up, a server log file is stored which contains the IP address, date and time of the call-up, the amount of data transferred and the requesting provider (access data) and thus documents the call-up. This access data is not evaluated and is deleted at the latest seven days after the end of the page visit.

22. YouTube

We use embedded YouTube videos on our website. YouTube is a service provided by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland (‘YouTube’). When you visit a page with an embedded YouTube video, a connection to YouTube's servers is established.

This tells YouTube which pages you visit. If you are logged into your YouTube account, YouTube can also assign this data to you personally. You can prevent this by logging out of your YouTube account beforehand. When a video is started, YouTube collects data about your user behaviour with the help of cookies (see above under ‘Cookies’). 23. Social Media

We do not collect any personal data ourselves by means of the social plugins shown or through their use because we use simple link or 2-click solutions. This serves to prevent data from being transferred to the service providers without the user's knowledge. Such a transfer only takes place when the link has been used and a login has been carried out in the user profile. A connection to the respective platform is then established. Data can then be transferred to the service provider and stored there in order to link interests and offers. The following providers are available:

24. Duration of Processing and Deletion

Your data will only be processed for as long as it is necessary for achieving the above-mentioned processing purposes; for this purpose, the legal bases indicated in the context of the processing purposes apply accordingly.

We delete or block personal data in accordance with legal requirements after one of the aforementioned periods has expired and, if no period is specified, as soon as the data in question is no longer required for the purposes stated here or for other justified purposes, or when a legally prescribed storage period expires.

25. Data Transmission

We only pass on your personal data to third parties if:

  • you have given your express consent in accordance with Art. 6 para. 1 lit. a) GDPR,
  • this is legally permissible and, in accordance with Art. 6 para. 1 lit. b) GDPR, is necessary for the fulfilment of a contractual relationship with you or the implementation of pre-contractual measures,
  • under Art. 6 para. 1 lit. c) GDPR there is a legal obligation to pass on the data,
  • we are required by law to transmit data to state authorities, e.g. tax authorities, social insurance agencies, health insurance companies, supervisory authorities and law enforcement agencies,
  • the transmission is necessary in accordance with Art. 6 para. 1 lit. f) GDPR in order to safeguard legitimate company interests and to assert, exercise or defend legal claims, and if there is no reason to assume that you have an overriding protectable interest in the non-disclosure of your data,
  • in accordance with Art. 28 GDPR, we use external service providers, so-called contract processors, who are obliged to handle your data with due care.

When transmitting data to external bodies in third countries, i.e. outside the EU, we ensure that these bodies will treat your personal data with the same care as they would within the EU.

Data will only be transferred to countries where the European Commission has confirmed an adequate level of protection or where we ensure the careful handling of personal data through contractual agreements or appropriate safeguards.

27. Zementa (Pixel)

We use cookies from Zemanta Inc, 33 West 17th Street, Midtown, New York 10011 (an Outbrain company) if you have given your consent to this before visiting this website in accordance with Art. 6 para. 1 lit. a. DSGVO have given . By using these cookies, each end user is assigned a unique user ID that enables personalised tracking of users.
