The protection of your privacy is important to us. If and to the extent that you voluntarily provide us with personal data, such data will be processed in accordance with the provisions of the EU Basic Data Protection Ordinance (DS-GVO), which will apply from 25th of May 2018, as well as the statutory data protection provisions of the Federal Data Protection Act (BDSG) and the Telemedia Act (TMG). Of course, all data will be treated confidentially. With the following data protection information we would like to explain to you in detail how data is handled.

1. General information about the collection of personal data

1.1 General

In principle, the collection, processing and use of personal data for the use of our Internet presence is limited to the necessary extent and the necessary data. Personal data are all data that are personally identifiable to you, e.g. name, address, e-mail addresses, user behavior.

If you contact us by e-mail or via a contact form, the data you provide voluntarily (e-mail address, if applicable name, address, etc.) will be stored by us in order to answer your questions. We delete the data arising in this context after the storage is no longer necessary, or limit the processing if statutory retention obligations exist.

If we use contracted service providers for individual functions of our offer or would like to use your data for advertising purposes, we will inform you in detail about the respective processes below. We also specify the defined criteria for the storage period.

2. Your rights

You have the right:

  • to request information about your personal data processed by us in accordance with Art. 15 DS-GMO. In particular, you may obtain information about the purposes of processing, the category of personal data, the categories of recipients to whom your data have been or will be disclosed, the planned storage period, the existence of a right to rectification, deletion, restriction of processing or objection, the existence of a right of appeal, the origin of your data, if these have not been collected by us, and the existence of automated decision-making including profiling and, if applicable, the processing of your data. require meaningful information on their details;
  • to immediately request the correction of incorrect or complete personal data stored by us in accordance with Art. 16 DS-GVO;
  • to request the deletion of your personal data stored with us in accordance with Art. 17 DS-GVO, unless the processing is necessary to exercise the right to freedom of expression and information, to fulfil a legal obligation, for reasons of public interest or to assert, exercise or defend legal claims;
  • pursuant to Art. 18 DS-GMO, to restrict the processing of your personal data if you dispute the accuracy of the data, if the processing is unlawful but you refuse to delete the data and we no longer need the data, but if you need it to assert, exercise or defend legal claims or if you have filed an objection to the processing pursuant to Art. 21 DS-GVO;
  • to receive your personal data provided to us in a structured, current and machine-readable format in accordance with Art. 20 DS-GMO or to request the transmission to another person responsible;
  • in accordance with Art. 7 para. 3 DS-GMO, to revoke your consent to us at any time. As a result, we are no longer allowed to continue the data processing based on this consent for the future and complain to a supervisory authority in accordance with Art. 77 DS-GMO. As a rule, you can contact the supervisory authority at your usual place of residence or workplace or at our company headquarters.

     

3. Collection of personal data when you visit our website

If you use our website www.gloria-garten.de for information purposes only, i.e. if you do not register or otherwise provide us with information, we only collect the personal data that your browser transmits to our server. If you wish to view our website, we collect the following data, which is technically necessary for us to display our website to you and to ensure stability and security:

IP address

  • Date and time of the request
  • Time zone difference to Greenwich Mean Time (GMT)
  • Content of the request (specific page)
  • Access Status/HTTP Status Code
  • The amount of data transferred in each case
  • Website from which the request comes
  • Browser
  • Operating system and its interface
  • Language and version of the browser software.

The mentioned data will be processed by us for the following purposes:

  • Ensuring a smooth connection of the website,
  • Ensure comfortable use of our website,
  • Evaluation of system security and stability as well as
  • For other administrative purposes.

The legal basis for data processing is Art. 6 para. 1 sentence 1 lit. f DS-GMO. Our legitimate interest follows from the purposes listed above for data collection. Under no circumstances do we use the data collected for the purpose of drawing conclusions about you personally.

In addition, we use cookies and analysis services when you visit our website. You will find more detailed explanations under sections 9. and 11. to 14. of this data protection declaration.

4. Further functions and offers of our website

In addition to the informational use of our website, we offer various services that you can use if you are interested. As a rule, you must provide further personal data, which we use to provide the respective service and to which the aforementioned data processing principles apply. The legal basis is Art. 6 para. 1 sentence 1 lit. a, b and f DS-GMO.

In some cases we use external service providers to process your data. These have been carefully selected and commissioned by us, are bound by our instructions and are regularly checked.

Furthermore, we may pass on your personal data to third parties if we offer contracts or similar services together with partners. You will receive more detailed information on this when you provide your personal data or in the description of the respective offer used.

If our service providers or partners are based in a country outside the European Economic Area (EEA), we will inform you of the consequences of this circumstance in the description of the offer it makes, if applicable.

We use the most common SSL (Secure-Socket Layer) method within the website in conjunction with the highest level of encryption supported by your web browser. This is usually 256-bit encryption. If your browser does not support 256-bit encryption, we use 128-bit v3 technology instead. Whether a single page of our website is transmitted in encrypted form can be seen from the closed display of the key or lock symbol in the lower status bar of your browser.

We also use suitable technical and organisational security measures to protect your data against accidental or intentional manipulation, partial or complete loss, destruction or unauthorised access by third parties. Our security measures are continuously improved in line with technological progress.

5. Use of our spare parts shop

If you want to order in our spare parts shop (shop.gloriagarten.de), it is necessary for the conclusion of the contract that you enter your personal data, which we need for the completion of your order. Required information for the execution of the contracts are marked separately, further information is voluntary. We process the data provided by you to process your order. For this purpose we can pass on your payment data to our house bank. The legal basis for this is Art. 6 para. 1 sentence 1 lit. b DS-GMO.

You can voluntarily create a customer account through which we can store your data for future purchases. When you create an account under "Register", the data you have provided will be saved revocably. All other data, including your user account, can always be deleted in the customer area.

We may also process the information you provide to inform you of other interesting products in our portfolio or to send you e-mails containing technical information.

We are obliged by commercial and tax law to store your address, payment and order data for a period of ten years. However, after[two years] we will limit processing, i.e. your data will only be used to comply with legal obligations.

To prevent unauthorized access to your personal data, especially financial data, the order process is encrypted using TLS technology.
 

6. Newsletter

With your consent, you can also receive separate information about current and future products (by phone or e-mail).  

We use the double opt-in procedure to register to receive this information by e-mail newsletter. This means that after your registration we will send you an e-mail to the specified e-mail address in which we ask you to confirm that you would like the newsletter to be sent. In addition, we store your IP addresses and the time of registration and confirmation. The purpose of the procedure is to be able to prove your registration and, if necessary, to clarify a possible misuse of your personal data. After your confirmation we will save your e-mail address for the purpose of sending you the newsletter. The legal basis is Art. 6 para. 1 sentence 1 lit. a DS-GMO.

You can revoke your consent at any time and unsubscribe from receiving information about current and future projects. You can declare your revocation by clicking on the link provided in every newsletter e-mail, by e-mail to info@gloria-garten.com or by sending a message to the contact data specified under 1.2.

We would like to point out that we evaluate your user behaviour when sending a newsletter. For this analysis, the e-mails sent contain so-called web beacons or tracking pixels, which represent single-pixel image files stored on our website. For the evaluations, we link the data mentioned in section 3. and the web beacons with your e-mail address and an individual ID.
 

7. Competition

If you voluntarily provide us with your personal data in the context of a competition conducted by us for participation in the respective competition, we process and use this data exclusively to the extent necessary to carry out the competition and to determine and notify the winners. The legal basis is Art. 6 para. 1 sentence 1 lit. a DS-GMO. In addition, the respective terms and conditions of participation in the competitions shall apply.
 

8. Objection or revocation against the processing of your data

If you have given your consent to the processing of your data, you can revoke this at any time. Such a revocation influences the permissibility of processing your personal data after you have given it to us.

If we base the processing of your personal data on the weighing of interests, you may object to the processing. This is the case if processing is not necessary in particular to fulfil a contract with you, which is described by us in the following description of the functions. When exercising such objection, we ask you to explain the reasons why we should not process your personal data as we have done. In the event of your justified objection, we will examine the situation and either stop or adjust data processing or point out to you our compelling reasons worthy of protection, on the basis of which we will continue processing.

Of course, you can object to the processing of your personal data for purposes of advertising and data analysis at any time. You can inform us about your advertising objection under the contact data mentioned in section 1.2 above.
 

9. Use of cookies

In addition to the data mentioned under point 3., cookies are stored on your computer when you use our website. Cookies are small text files that are stored on your hard disk in the browser you use and through which certain information flows to the place that sets the cookie (here by us). Cookies cannot run programs or transmit viruses to your computer. They serve to make the Internet offer more user-friendly and effective overall.

This website uses the following types of cookies, the scope and functionality of which are explained below:

  • Transient cookies, i.e. cookies that are automatically deleted when you close your browser. This includes in particular the session cookies. These store a so-called session ID, with which different requests of your browser can be assigned to the common session. This will allow your computer to be recognized when you return to our website. Session cookies are deleted when you log out or close your browser.
  • Persistent cookies, i.e. cookies regarding which you can configure your browser settings according to your wishes. Here, for example, the acceptance of third party cookies or all cookies can be rejected. Please note that you may not be able to use all functions of this website.

We use cookies to identify you for follow-up visits if you have an account with us. Otherwise you will have to log in again for each visit.

The cookies used are not recorded by your browser, but by your Flash plug-in. We also use HTML5 storage objects that are stored on your mobile device. These objects store the required data independently of your browser and do not have an automatic expiry date. 10. Online application

By sending us your application documents on our career page, you are expressing your interest in taking up employment with us. The data requested by you serves exclusively the purpose of the job search. You agree that the personal data you provide will be stored and processed for this purpose. The legal basis is Art. 6 para. 1 sentence 1 lit. a DS-GMO.

Your data will be used within our company to fill a suitable position. Only authorized employees have access to your data. Your data will only be passed on to the relevant personnel areas and departments.

Your data is used exclusively for the recruitment process. Your data will be stored for a period of 5 months after the end of the concrete application procedure. You are entitled to revoke your consent to the use of your personal data at any time in accordance with our explanations under item 7. The revocation can be declared by e-mail to personal[at]gloria-garten.com or by sending a message to the contact details given in section 1.2.

We would like to point out once again that we use both technical and organisational security measures in accordance with section 4 to protect your data from manipulation, loss, destruction and unauthorised access. Your data is encrypted to prevent misuse of the data by third parties - SSL encryption is used for this purpose. We endeavour to adapt our security measures in line with technological developments.

11. Use of Google Analytics

This website uses Google Analytics, a web analysis service of Google Inc. "("Google"). Google Analytics uses cookies, which are text files placed on your computer, to help the website analyze how users use the site. The information generated by the cookie about your use of this website is usually transferred to a Google server in the USA and stored there. However, if IP anonymisation is activated on this website, Google will reduce your IP address within Member States of the European Union or in other states party to the Agreement on the European Economic Area beforehand. Only in exceptional cases will the full IP address be transmitted to a Google server in the USA and shortened there. On behalf of the operator of this website, Google will use this information to evaluate your use of the website, to compile reports on website activity and to provide the website operator with further services associated with website and Internet use.

The IP address transmitted by your browser in the context of Google Analytics is not merged with other Google data.

You may refuse the use of cookies by selecting the appropriate settings on your browser, however please note that if you do this you may not be able to use the full functionality of this website. This website uses Google Analytics with the extension "_anonymizeIp()". As a result, IP addresses are further processed in abbreviated form, so that a personal relationship can be ruled out. As far as the data collected about you is personal, it will be excluded immediately and the personal data will be deleted immediately.

We use Google Analytics to analyse and regularly improve the use of our website. We can improve our offer and make it more interesting for you as a user. For the exceptional cases in which personal data is transferred to the USA, Google has submitted to the EU-US Privacy Shield. 12. Use of Hotjar

This website uses the web analysis service Hotjar of Hotjar Ltd, Level 2 St Julians Business Centre, 3, Elia Zammit Street, St Julians STJ 1000, Malta, (https://www.hotjar.com) to analyse and regularly improve the use of our website. We can improve our offer and make it more interesting for you as a user. The legal basis for the use of Hotjar is Art. 6 para. 1 sentence 1 lit. f DS-GMO.

For this analysis, cookies (for more details see paragraph 9.) are stored on your computer. Hotjar stores the information collected in this way exclusively on its server in Ireland. 13. Use of Conversion-Tracking

This website uses conversion tracking, a technology from Adform, for marketing and optimization purposes. The conversion tracking cookie is set when a user contacts an ad placed by Adform. The data collected and stored in this way can be used to create user profiles under a pseudonym. Cookies are used for this purpose (for more information see section 9.).

The data collected with the Adform technology will not be used to personally identify the visitor of a website and will not be combined with personal data about the bearer of the pseudonym without the separately given consent of the person concerned. 14. Retargeting

This website uses Adform's retargeting technology for marketing and optimization purposes. Advertising media are displayed based on a cookie-based analysis of previous user behavior. The data collected and stored in this way can be used to create user profiles under a pseudonym.

The data collected with the Adform technology will not be used to personally identify the visitor of a website and will not be combined with personal data about the bearer of the pseudonym without the separately given consent of the person concerned. 15. Facebook

We use a social media plug-in from Facebook. We use the so-called two-click solution. This means that when you visit our site, no personal data is initially passed on to the providers of the plug-ins. You can recognize the provider of the plug-in by the marking on the box above its initial letter or the logo. We offer you the possibility to communicate directly with the provider of the plug-in via the button. Only if you click on the marked field and thereby activate it, the plug-in provider receives the information that you have accessed the corresponding website of our online offer. In addition, the data mentioned under point 3. of this declaration will be transmitted. In the case of Facebook, according to the provider in Germany, the IP address is anonymized immediately after collection. By activating the plug-in, personal data is transferred from you to the plug-in provider and stored in the USA. Since the plug-in provider collects data mainly via cookies, we recommend that you delete all cookies before clicking on the grayed-out box using your browser's security settings.

We have no influence on the data collected and data processing processes, nor are we aware of the full extent of data collection, the purposes of processing, the storage periods. We also have no information on the deletion of the data collected by the plug-in provider.

The plug-in provider stores the data collected about you as user profiles and uses these for the purposes of advertising, market research and/or demand-oriented design of its website. Such an evaluation takes place in particular (also for not logged in users) for the representation of demand-fair advertisement and in order to inform other users of the social network about your activities on our website. We have included YouTube videos in our online offering, which are stored at http://www.Youtube.de or http://www.YouTube.com and can be played directly from our website.
